Right-of-Way Permits
All work performed on public rights-of-way require a permit to be issued to a licensed contractor.
This work includes, but is not limited to, the construction, reconstruction and remodeling of storm drains, irrigation ditches, fire lines, sewer and water lines, sewer and water mains, curb and gutters, sidewalks, streets, potholing, boring, traffic-control devices and similar improvements which are constructed on public ROW, easements and other public property, and utility services on private property between the property line and the building
This permit requirement is enforced by the Westminster Municipal Code, Section 9-2-1.
ROW Permits
All permits will receive a review by the Engineering Division under the direction of the City Engineer. Permit applications and supporting documents, including traffic-control plans, are required to be uploaded into our Online Permit Manager. Emails or hard copies will be not be processed.
The Colorado 811 locate confirmation number must be entered on all applications.
All utilities must be identified through the locate process prior to excavation of soil, including boring, can take place. In the event, that a City Utility cannot be located within the specified boundaries of the request area; the contractor/excavator will be notified by email and/or phone of a mandatory on-site meeting to discuss alternate measures for protecting the utility. No excavation of soil, including boring, is permitted until the on-site meet has taken place and all utilities have been located. Failure to comply will be deemed unreasonable action by the contractor/excavator and may result in the contractor/excavator assuming all liability for damages to such utilities.
- Red - Electric power lines, cables, conduit, and lighting cables
- Blue - Drinking water
- Orange - Telecommunication, alarm or signal lines, cables, or conduit
- Purple - Reclaimed water, irrigation, and slurry lines
- Yellow - Natural gas, oil, steam, petroleum, or other gaseous, or flammable material
- Pink - Temporary survey markings, unknown/unidentified facilities
- Green - Sewers and drain lines
- White - Proposed excavation limits or route
Class D Public Way Contractor's License
Contractors must have a current Class D public way contractor's license and be in good standing with the City of Westminster to apply for a ROW Permit. The New requirements to obtain a Class D Public Way Contractor's License, as of 2023, are the following:
- A Letter of Credit or cash escrow (check) are the only acceptable forms for Surety. Bonds are not allowed.
- Surety shall be payable to the city in the amount of $10,000.
- Insurance coverage in accordance with the below schedule
Class E Public Way Contractor's License
Contractors must have a current Class E public way contractor's license and be in good standing with the City of Westminster to apply for a ROW Permit. The scope of work is limited to non-invasive construction activities with the Class E public way contractor’s license. The requirements to obtain a Class E Public Way Contractor's License, as of 2025, are the following:
- A Letter of Credit or cash escrow (check) are the only acceptable forms for Surety. Bonds are not allowed.
- Surety shall be payable to the city in the amount of $500.
- Insurance coverage in accordance with the below schedule

- Statutory-In conformance with the Worker's Compensation Act of Colorado

This insurance shall protect the contractor against all claims under the worker's
compensation laws and employer's liability laws of the State of Colorado.

- Comprehensive automobile liability:
- Bodily injury: $1,000,000 each occurrence
- Property damage: $1,000,000 each occurrence
This insurance shall be written in comprehensive form and shall include all motor vehicles licensed for highway use, whether they are owned, non-owned, or hired.
- Comprehensive general liability:
- Bodily injury: $1,000,000 each occurrence/$2,000,000 aggregate
- Property damage: $1,000,000 each occurrence/$2,000,000 aggregate
This insurance shall be written in comprehensive general liability form and shall include coverage for subcontractors. If work undertaken may require blasting, explosive conditions, or underground operations, the comprehensive general liability coverage shall include coverage of blasting, explosion, collapse of buildings, or damage to underground property. The insurance required in this Section shall be continued throughout the period of the contract work and maintenance period.
- When it is time to renew your certificate of insurance, submit new surety and insurance to the Engineering Division via email meeting the new requirements.
The Contractor License form can be downloaded in the following. Once completed and signed, submit to the Engineering Division via email with the Subject Line: Public Way Contractor License Application: [insert contractor name]. In addition, attach the required bond and insurance certificate. This license requirement is non-negotiable and enforced by the Westminster Municipal Code Section 5-5-5.
ROW Permit fees are established by the City Engineer per Westminster Municipal Code Section 9-2-1(B). The following fees apply to ROW Permits as of June 28, 2022:
- $50 Administrative Fee
- $15.29 per square foot of street cut. For additional Street Cut Impact Fee requirements, see Westminster Municipal Code Section 9-2-8.
- $300 per occurrence for Stop Work
- $500 per occurrence for Unauthorized Work
"Stop Work" is defined as any criteria described in Section January 28, 2000 of the City's Standards and Specifications for the Design and Construction of Public Improvements and/or failure to perform corrective work within five business days of notice.
"Unauthorized Work" is defined as performing any work described in Westminster Municipal Code Section 9-2-1(A) without a City of Westminster ISSUED ROW Permit. If a contractor receives two Unauthorized Work fees, regardless of the time between fees, the contractor's Class D Public Way License will be suspended for one year.

- What is a ROW Permit?

A ROW (Right of Way) permit is a permit that allows work to be performed in the City owned Right of Way or Easements.
- Can anyone apply for a ROW Permit?

No. Only Licensed, Bonded, and Insured Class D or Class E Public Way Contractors can apply for and receive ROW permits.
- What is the difference between a Class D and Class E Public Way Contractor?

A Class D Public Way Contractor can perform any approved work in the ROW. A Class E Public Way Contractor is limited to perform only non-invasive work in the ROW, including traffic control, surveying, landscaping, driveway cuts, curb ramps, and tree trimming. Class D and Class E have different surety requirements.
